How can Amazon promote "Prime"delivery

How can Amazon promote "Prime" delivery, charge you for the membership and yet not deliver? A smaller company would be hit with false advertising. Who are they screwing to get away with this? I knew they were crooked when they didn't have to pay taxes but they can really do whatever they want and it's OK?
