I month out of warranty

I live in a street full of Mirvac homes in Bulimba, there has been the same problem with many houses in the street with the plumbing of the bath. We had the problem a few months ago but because I travel I only got around to phoning them in April, to discover I was one month out of warranty, so they refused to fix it. But the most laughable point is they told us because we didn't use the bath is why its broken. They knew about the problem, still declined to take any responsibility.
By law I suppose they are in their right but as a big company wanting to gain and keep a good reputation they are doing the wrong thing. I certainly would never use or recommend they and reading some of these reviews I should have known better.
They new the fault but only waited for the complaints, I'm sure if it was electrical they would have fixed all the houses.
